Paranormal TV is pleased to hear from its users and welcomes
your comments regarding this Site. However, we do not consider creative ideas,
suggestions, or materials other than those it has specifically requested. This
policy is designed to avoid misunderstandings if projects developed by
Paranormal TV’s professional staff seem to others to be similar to their own
creative work. Accordingly, we request that your comments relate to those

feedback, ratings, tips, videos, notes, postings, suggestions, concepts,

Code of Conduct
Further, you agree that, with respect to the Site and any
User-Generated Content, you will not (i) include any content (including,
without limitation, any music or video produced or owned by a third party) that
violates a third party's copyright, proprietary or contractual rights or rights
of publicity or privacy or any applicable law, rule, regulation or order; (ii)
publish falsehoods or misrepresentations portrayed as fact; (iii) delete or
modify any logos, legal notices, proprietary notices or disclaimers that you do
not have the proper authority and permission to modify or delete, as

assume any obligation, to review any User‑Generated Content prior to its
display on this Site. We may modify, remove or refuse to display any
User-Generated Content for any reason.
You agree not to (i) use this Site, the Content, or any
products or services included on or available through this Site for any
unlawful purpose, including, without limitation, effecting, demonstrating or

THIS AGREEMENT OR THIS SITE, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS,
REVENUE, OR BUSINESS INTERRUPTION, OR LOSS OF COMPUTER PROGRAMS OR DATA ARISING
FROM (I) YOUR USE OF OR INABILITY TO USE THIS SITE, OR (II) CONTENT, PRODUCTS,
AND/OR SERVICES RECEIVED THROUGH OR ADVERTISED ON THIS SITE OR RECEIVED THROUGH

damages, costs and expenses (including, without limitation, reasonable
attorneys' fees) arising from (i) your use of this Site and/or any Content,
products or services, breach of any warranties, representations, covenants and
agreements set forth in this Agreement, including, without limitation, your
unauthorized use of any Content or submission of User-Generated Content, or
(ii) use of this Site, and/or any Content, products or services, breach of
any warranties, representations, covenants and agreements set forth in this
Agreement, including, without limitation, unauthorized use of any Content or
submission of User-Generated Content, by anyone using your computer. By using
this Site, or making any submissions to us, whether or not through this Site,
you are hereby agreeing to release the Comcast Parties from any and all claims,
demands, debts, obligations, damages (actual or consequential), costs, and
expenses of any kind or nature whatsoever, whether known or unknown, suspected
or unsuspected, disclosed or undisclosed, that you may have against them
arising out of or in any way related to such disputes and/or to any Content,
information, materials, products and services obtained or used through this
Site or to any disputes regarding use of ideas and/or related materials
submitted to us. We reserve the right to
assume the exclusive defense and control of any matter subject to
indemnification by you, and you agree to cooperate with Paranormal TV and
Comcast in our defense. You may not approve or disapprove the settlement or
disposition of any such claim, lawsuit or proceeding without the prior written
consent of the applicable Comcast Parties, which consent will not be
unreasonably withheld or delayed.
YOU HEREBY AGREE TO WAIVE THE APPLICATION OF ALL LAWS THAT
MAY LIMIT THE EFFICACY OF SUCH RELEASES. FOR EXAMPLE, YOU SPECIFICALLY AGREE TO
WAIVE THE PROVISIONS OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH PROVIDES IN
RELEVANT PART: "A GENERAL RELEASE
DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST
IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IS KNOWN BY HIM MUST
HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."
Independent Investigation
Paranormal TV reserves the right (but is not obligated to)
to investigate suspected violations of the terms and conditions of this
Agreement whenever Paranormal TV becomes aware of possible violations. Such an investigation may include gathering
information from the user and the complaining party and reviewing materials on
Paranormal TV’s or its vendors’ servers and systems. During an investigation, Paranormal TV may
remove any and all disputed material from Paranormal TV’s servers and
systems. If Paranormal TV believes, in
its sole discretion, that a violation of the terms or conditions of this
Agreement has occurred, Paranormal TV may take any action it deems appropriate
under the circumstances known to it, which may include removal of material from
Paranormal TV’s servers and systems, warnings, and/or suspension or termination
of a user’s access to the Site.
Violations also could subject users to criminal or civil liability.
Miscellaneous
This Agreement shall be governed by and construed in
accordance with the laws of the Commonwealth
of Pennsylvania. By using
this Site, you agree to submit to the exclusive jurisdiction of the courts
located within Philadelphia,
Pennsylvania. This Agreement
shall be binding upon and inure to the benefit of the parties hereto and their
respective successors and assigns. If any provision of this Agreement is held
to be invalid or unenforceable, such provision shall be modified or eliminated
to the minimum extent necessary and the remaining provisions shall be enforced.
This Agreement constitutes the entire agreement between the parties hereto, and
supersede any other agreement, promise, or practice between the parties
relating to the subject matter hereto. Any headings or titles herein are for
convenience only and shall not be interpreted to affect the meaning of any
provision herein or the intent of the parties hereto. We reserve the right to
terminate your access to and ability to use this Site (or any portion thereof),
at any time (with or without notice). No waiver by either party of any right
hereunder shall constitute a waiver of this or any other right. Any
indemnification obligations, limitations of liability, disclaimers of
warranties, and any covenants that, by their terms should survive, shall
survive any termination or expiration of this Agreement.
Your use of this Site constitutes acceptance of this
Agreement. You hereby waive any and all
defenses you may have based on the electronic form of this Agreement and lack of
signing or other form of electronic execution by the parties hereto. You agree to abide by the terms and
conditions of this Agreement and any additional terms, conditions, rules, or
procedures imposed by Paranormal TV or by third-party content providers in
connection with content, software, or services available on, through or in
connection with this Site.
Paranormal TV shall be excused from its obligations for any
period to the extent that Paranormal TV is prevented from performing, in whole
or in part, its obligations under this Agreement, as a result of any acts of
God, any action(s), regulation(s), order(s) or request(s) by any governmental
or quasi-governmental entity (whether or not the action(s), regulations(s),
order(s), or request(s) prove(s) to be invalid), Internet or other
communications failure, equipment failure, earthquake, war, fire, flood,
explosion, unusually severe weather, hurricane, embargo, labor dispute or
strike (whether legal or illegal) labor or material shortage, transportation
interruption of any kind, work slow-down, civil disturbance, insurrection,
riot, foreign or domestic court order, third party non-performance (including
the acts or omissions of any suppliers, agents, or subcontractors) or any other
cause beyond Paranormal TV’s reasonable control affecting production or
delivery in any manner, including failure or fluctuations in electrical power,
heat, light, air conditioning or telecommunications equipment or lines or other
equipment, whether electronic or otherwise.
